Talent Application Terms

These Talent Application Terms (the "Terms") are an agreement between Pornstar on Call (the "Company," "we" or "us") and the person applying to work as an entertainer (the "Applicant," "Entertainer" or "you"). By checking the box on the application form or submitting an application, you agree to these Terms.

1. Lawful Entertainment Only - No Sexual Services

1.1 Pornstar on Call books lawful dance and party entertainment only. The Company does not offer, sell, arrange, facilitate, permit or tolerate prostitution, sexual contact, sexual acts or any other sexual services, and nothing paid to you through or because of the Company is for any such act.

1.2 You must never offer, agree to, request payment for or perform any sexual act or any illegal act at, before or after any event, or with any client or guest you meet through the Company. Any such act is outside the scope of any booking, is done entirely on your own and is not authorized by the Company.

1.3 A breach of this Section ends your relationship with the Company immediately, forfeits any unpaid booking fees for that event, and may be reported to law enforcement.

2. Independent Contractor - Not an Employee

2.1 If you are accepted and perform at any event, you do so as an independent contractor and not as an employee, agent, partner or joint venturer of the Company. You control how you perform, within these Terms and the law.

2.2 You are solely responsible for your own taxes, licenses, permits, insurance, travel, costumes and expenses, and you are not entitled to wages, overtime, benefits or workers' compensation from the Company.

2.3 Any engagement is governed by a separate written Independent Contractor Agreement. These Terms apply to your application and continue to apply to any engagement.

3. Full Personal Responsibility and Liability

3.1 You are solely and 100% responsible and liable for your own conduct, words, actions and omissions, including any sexual act, any illegal act, any injury or damage you cause and any breach of law or of these Terms.

3.2 The Company is not responsible or liable for any act you choose to commit, and you will not claim that the Company directed, requested, approved or knew of any prohibited act.

4. Indemnification and Hold Harmless

4.1 You agree to defend, indemnify and hold harmless Pornstar on Call and its owners, operators, staff and contractors from and against any and all claims, demands, losses, damages, fines, penalties, costs and expenses (including reasonable attorneys' fees) arising out of or related to your conduct, any sexual or illegal act by you, any breach of these Terms by you, or any violation of law by you.

4.2 To the fullest extent allowed by law, you release the Company from any claim arising from your own conduct or from the conduct of clients or guests at an event.

5. Age and Identity Verification

5.1 You must be at least 21 years old to apply or perform. Before any booking, you must provide a valid, unexpired government-issued photo ID, and the Company may require a selfie holding that ID to verify your identity and age.

5.2 Giving false, misleading or someone else's information or ID ends your application immediately.

6. Your Application

6.1 No Guarantee of Work. Applying does not guarantee acceptance, any booking, any number of bookings or any amount of pay. The Company may accept or decline any application, or end any engagement, at its sole discretion and without giving a reason.

6.2 Accuracy. You confirm that everything you submit, including photos, is accurate, is of you and was taken within a reasonable time.

6.3 Photos. You confirm that you own or have the right to share any photos you submit. The Company uses them only to review your application and, if you are accepted and agree in writing, to present you to clients.

6.4 Privacy. Your application information is handled as described in our Talent Privacy Policy and is kept private.

7. Conduct and Safety

7.1 You must follow all laws, all venue rules and the Company's conduct and safety rules at every event, and you must not be impaired in a way that affects safety.

7.2 You may end a performance and leave any event where you feel unsafe, and you should tell the Company as soon as you can.

8. General Terms

8.1 Governing Law and Venue. These Terms are governed by the laws of the State of Florida. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida.

8.2 Severability. If any provision is found unenforceable, the rest of these Terms remain in effect.

8.3 Changes. The Company may update these Terms by posting a new version on this page.

8.4 Electronic Acceptance. Checking the acknowledgment box or submitting the application is your electronic signature and has the same legal effect as a handwritten signature. The Company keeps a record of the date and time of your acceptance.
